Default Drink driving loophole in NZ

Just read this online and I'm wondering if its the same here in Aussie....

Police officer uses drink-driving loophole

A police officer is under internal investigation after avoiding a drink-driving blood test.

The former team policing officer failed an initial breath test but ended up in hospital before a blood test could be taken.

He had injured his head in the police station toilet.

The Land Transport Act prevents evidential blood tests being taken in hospital unless a person's injury was caused in a traffic accident.

Drink-drive lawyer Patrick Winkler says it's unheard of for someone to injure themselves deliberately to avoid being tested.

He says the law is designed to prevent tests being taken from people who are in hospital because of a genuine medical problem.

"It's about limiting the police powers of search, so we don't end up in a police state."

He says most people would not know about the loophole.

If some drunk idiot gets pulled over, falls out of the car and bangs his head on the ground the police aren't able to collect any substantial evidence that hes been drinking?

Back on topic away from bagging the IQ of Kiwis (which is an Australian national past time, poor old Kiwi's, we really love you guys) in WA they take you to hospital if you want a blood test, don't know about other states.
